Erik Menéndez’s wife, Tammi Menéndez, is once again celebrating her husband’s birthday apart.

“Happy Birthday Erik! It is his 35th birthday in prison! 😢,” Tammi, 62, wrote via X on Wednesday, November 25. “Thank You to everyone around the world for the wonderful Happy Birthday videos for Erik! 💝💌”

Tammi’s sweet birthday tribute comes two days after Erik, 54, and brother Lyle Menéndez’s resentencing hearing was postponed. On Monday, November 25, Judge Michael Jesic stated that he needed more time to review the case and would not be ready to render a decision by the originally scheduled hearing date of December 11. Erik and Lyle’s court date was subsequently moved to January 30 and 31.

The brothers are currently serving time at the Richard J. Donovan Correctional Facility. They were originally arrested in 1990 on two counts of first-degree murder after their parents, José and Kitty Menéndez, were found dead in their Beverly Hills home.

After two trials, Erik and Lyle were convicted of murder and sentenced to life without the possibility of parole. The pair have maintained they acted in self defense and claimed that their mother and father were physically, emotionally and sexually abusive.

Erik and Tammi connected while he was in prison by exchanging letters. The couple tied the knot in 1999 and Tammi has remained his loyal spouse since.

While Tammi has advocated for Erik and Lyle over the years, their once high-profile case recently received the renewed attention of the public after the siblings’ story was the center of a series of shows, including Ryan Murphy’s series Monsters and the Netflix documentary The Menéndez Brothers.

Following the interest, former Los Angeles District Attorney George Gascón recommended the brothers’ life sentence be reduced to 50 years including time already served. If approved, Erik and Lyle would be eligible for parole and immediate prison release. Tammi, for her part, was “disappointed” by Gascón’s decision to only suggest resentencing.

“Yesterday was a difficult and emotional day,” Tammi wrote via X in October reacting to the news. “I am Grateful to DA Gascon for his courage to seek resentencing for Erik. I am naturally disappointed he did not go further and act on his own belief that Erik and Lyle have served enough time in prison”

However, Gascón lost reelection and Nathan Hochman was elected as the new L.A. DA. Following his win, Hochman stated that the Menéndez’s case would be a “high priority” for him, but he would need additional time to review the facts.

“If I ask for additional time, it will be the time I actually need to conduct this review — and hopefully no additional time beyond that,” Hochman said in a November interview with TMZ. “Because one way or the other then Menéndezes, like every defendant, deserves a decision. They deserve a decision first by the DA’s office.”
